What is Divorce Mediation?

In mediation, the divorcing parties work out the arrangements of the divorce agreement outside of court. It is up to each party to decide whether or not to come to the mediation with an attorney, but mediation always proceeds with a mediator as the facilitator. The mediator is called a "neutral." When the parties reach an agreement on all the issues, the court signs the divorce documents to make it official.

The issues to be agreed upon in divorce mediation are the same as in any divorce, including child support and spousal support.

The Benefits of Divorce Mediation

Divorce mediation, compared to the traditional divorce litigation process, offers many benefits, including:

  • Time and cost: More often than not, mediation is a lot more inexpensive because there is less preparation time than there is for litigation. Plus, things go more quickly when the parties come to an agreement themselves without the court's intervention.
  • Mental well-being: Often, in traditional divorce litigation, each party is forced to characterize the other party in the most negative light possible. This is terrible for the children, and it's terrible for everyone in such a public setting as a courtroom. Mediation allows you more privacy and the ability to come to terms with the various divorce issues in a more civilized manner.
  • Empowerment: Rather than having the judge make the determinations and hand them down to you, mediation allows you to have control over the outcome and process.

Collaborative Law

Another alternative method for divorce is collaborative law. In collaborative law all of the parties, including the lawyers, agree that they will not take the case to trial. If everyone works within the process, it can make the process even less contentious.
