Modify Your Divorce Agreement
Divorce agreements are not as set in stone as people think. The Massachusetts courts understand that as time passes, circumstances may change. Sometimes the divorce agreement needs to be modified to reflect the new state of affairs.
At our Boston area law firm you will find attorneys who have experience modifying divorce agreements. You will also find lawyers who focus on finding the simplest cost-effective solutions that fit your needs.
Reasons for Modification
Circumstances change all the time, but not all changes in circumstances will justify a post divorce modification in the eyes of the court. The change in circumstances must be substantial, involving matters such as:
- Lost job
- Serious change in job status or pay
- Changing financial needs of the child or spouse receiving support
- Work relocation
For these reasons, we can work with the court to seek child custody and visitation modifications and child support and spousal support modifications.
Enforcement and Contempt of Court
Another circumstance that often arises is when one of the ex-spouses does not live up to the terms of the divorce agreement. This happens most frequently with child support, spousal support, and child custody. Even if the agreement was reached by mediation, the court still signs off on the document and can hold the party in contempt.
When your ex-spouse is not living up to the terms of the agreement, we can file for contempt of court, seeking a court order demanding compliance with the divorce decree.
